Risky business

Article Abstract:

Risks encountered in construction projects may be classified as contractual or construction. Contractual risks arise from the relationship between the owner and the designer. This type of risk can be minimized by using clearly-written documents and by administering contracts efficiently and fairly. Construction risks originate from physical causes including the environment and site conditions. They may also start from improperly planned construction risks. This type of risk cannot be eliminated but can be managed through prudent risk allocation.

The changing role of lawyers in construction

Article Abstract:

The inappropriate, complicated and expensive cost of litigation and arbitration processes have promoted negative effects on the construction industry's perception of lawyers. However, these lawyers play significant roles in the improvement of construction projects. Such roles include providing positive inputs for the benefit of the project and facilitating harmonious relationships among workers through counseling services.

The use of NDCs in owner-contractor agreements have been shown to reduce costs by an average of 5% This is contrary to previous claims that NDCs place a burden on contractors that are parted on to owners as additional costs. However, NDCs create an unfavorable working atmosphere between owners and contractors and thus, should not be included in contracts.
