Problems with Development Gains

Article Abstract:

Development gains tax was introduced by the finance act of 1974 in the United Kingdom. It taxes the disposals of interest in land taking place after December 18, 1973. This is determined by a contract or arrangement in writing or by memorandum before that date. If the contract is subsequently changed it must be a minor change and not more beneficial to the owner. In the case described, the House of Lords claimed that the meeting held between buyer and seller did not constitute an agreement made, that only a document containing all essential terms would suffice.
