Corporate liability: security and violence

Article Abstract:

Nurse managers should know that their hospitals have corporate liabilities for inadequate security leading to injuries or incidences of violence. These liabilities include poor supervision and negligent hiring of bad employees. Workplace violence or failure to warn employees of dangerous coworkers are other liabilities. Dealing with problem employees is complicated by considerations of psychological impairment and the Americans with Disabilities Act.

Article Abstract:

Regulators and legislatures are requiring that hospitals adopt additional security measures due to workplace violence. The problem is one of the country's top killers, and hospitals are not immune to this trend. In fact, health care's mission may make hospitals more susceptible to the social ills leading to violence, including drug abuse, alcoholism, etc. The hospital's image suffers from such crime and the crime victims often file liability suits.

Article Abstract:

Nurses in management are exposed to risks of lawsuits for discrimination against employees, including disabled ones. Employee discrimination suits can be filed for failure to accomodate disabilities or for wrongful termination. Various lawsuits in these areas are discussed. Nurse managers should make sure that their legal or human resources departments review their decisions to ensure against lawsuits.
