Higher premiums could spur renewed tort reform interest

Article Abstract:

Premium increases for physician's liability insurance may be forthcoming and could prompt action on tort reform proposals in Congress. Indications that premiums may increase soon include a 9% rise in medical malpractice claims and a 10% increase in the severity of claims. Because tort reform is increasingly viewed as a strategy to contain costs, indications of an impending increase in physician's liability insurance premium rates could prompt action on some of the more than 20 tort reform proposals circulating in Congress.

Senate showdown looms; medicine wary, but optimistic of another tort reform victory

Article Abstract:

The American Medical Association National Leadership Conference, held in Mar 1995, simultaneously boosted the support of lobbyists that were in Washington D.C. to encourage members of Congress to pass reform measures that would benefit the medical industry, such as imposing caps on liability awards. The Senate will consider three liability bills, including one that covers 'pain and suffering' awards, introduced by Orrin Hatch.

Encouraging words on tort reform

Article Abstract:

Supporters of tort reform hope a strong bill will result from conference to reconcile the House and Senate versions. House Speaker Newt Gingrich did not specifically mention medical liability when he criticized the Senate's product liability limits. An alliance of health delivery organizations and pharmaceutical companies has raised $750,000 to advertise its proposed cap on damages.
