Legal accountability in changing practice

Article Abstract:

The changing demands of nursing has led to confusion over the legal accountability of nursing staff in the late 1990s. Nursing procedures often infringe into associated practices which are not taken into account in existing law. Patient care is taken into account under civil law in the UK, with nurses having to fulfill the duty of care requirement which is established during a patient-nurse relationship. Nurse specialisation brings nurses into contact with areas which are not covered under their legal accountability under UK law.

Article Abstract:

The number of UK nurses applying to work in the Middle East appears not to have been seriously affected by adverse publicity surrounding the death of nurse Yvonne Gilford and the subsequent jailing of two British nurses for her murder at the end of 1996. Nursing verifications to work in Saudi Arabia fell to 73 in the period after the murder in Jan 1997, compared with 107 verifications in Jan 1996. Nursing agencies make sure potential nurses are fully aware of the different laws in Middle Eastern countries.

Article Abstract:

The provisions of the Human Rights Act 1998 and its effects on the work of nurses in the UK are described. The law on the right to life, to liberty and security, and the duties it places on National Health Service trusts, is analysed.
