Mild reaction to silicone liability risk

Article Abstract:

Insurance companies that deal with physician liability for breast implants and breast augmentation are not changing coverage policies despite federal restrictions on silicone gel implants. One reason insurers are maintaining current policies is because they have not yet had an expensive liability case. Also, implant cases have been considered product liability problems. However, some insurers feel that physicians could be held liable in some product liability cases, and if silicone implants are linked to higher risks of cancer and autoimmune dysfunction, implant cases would become medical liability problems.

Enterprise liability backers stand firm

Article Abstract:

Physicians and other groups object to the idea of enterprise liability, but many groups believe that some variation on this system is inevitable. Enterprise liability would hold hospitals and other medical institutions liable for malpractice suits instead of physicians. However, physicians believe that the quality control measures that would be involved in such a system would rob them of professional autonomy. Medical groups advocate a system of tort reform that includes caps on damages and lawyers' fees.

Delegates consider slate of liability issues

Article Abstract:

The American Medical Association House of Delegates approved a report on state and federal limits for physicians' professional liability. In addition to controls on noneconomic damages, the plan included monitoring programs in Vermont and Minnesota that involve protection for doctors who follow practice guidelines. However, the delegates asked the federal government to postpone laws concerning practice parameters until study shows whether quality of care improved.
