Societies caught in fraud cases: product liability lawsuits raise questions about CME vs. promotion

Article Abstract:

A US District Court Judge ruled that medical societies cannot be exempt from product liability lawsuits concerning spinal fusion systems because the societies did market the systems at meetings and seminars. The North American Spine Society, American Academy of Orthopaedic Surgeons, American Assn. of Neurological Surgeons and Scoliosis Research Society anticipate high legal fees from impending lawsuits. Over 5,000 patients claim to have been harmed by use of pedicle screws in treatments for which the Food and Drug Administation has not approved their use.

Delegates: cancel CLIA, dump data bank

Article Abstract:

The American Medical Assn (AMA) House of Delegates has voted to ask for the repeal of the Clinical Laboratory Improvement Amendments of 1988 and the discontinuation of the National Practitioner Data Bank. Congress is unlikely to accede to the request, and some AMA officials feel that the house's decision will hinder AMA's negotiations with Congress. The house passed contradictory proposals on the data bank, one demanding it be terminated, the other calling for reform of its operations.

Liability rates likely to inch up during 1993

Article Abstract:

Physician liability premiums will increase in 1993 for the first time in years. The Physician Insurance Assn of America says that rates will increase 3-5%. One insurance executive attributes the increases to a rise in both the frequency and severity of claims. Others claim that falling interest rates will raise premiums for several years to come. Some said that after years of stable or declining rates increases were long overdue.
