Navigating Colorado River abstention

Article Abstract:

The Supreme Court's decision in Colorado River greatly expanded the doctrine of abstention in the federal courts. Insurance counsel, who often deal with state and federal issues, should be aware of this decision's effects. In the decision, and later decisions, the court ruled that federal judges have a great deal of discretion over their court dockets, and can use this discretion to grant abstention with no reason other than time constraints. Topics that can be affected by abstention and the implications for insurance counsel are discussed.
