Health plans - subrogation - offset for attorney fees

Article Abstract:

Pacific Holding Co Employee Welfare Benefit Plan holder Jean McIntosh filed a case against the plan for its subrogation clause did not mention anything about attorney's fees. The insurance companies settled with McIntosh and she dropped the cases she filed. However, the settlement was paid into escrow because this was the advice given by the plan to the insurance firms. McIntosh sought action seeking part of the settlement as attorney fees. The Eight Circuit upheld the claim for attorney's fees, citing that the district court made no findings on the value of lawyer's services to the plan.
