Price tag is complex for recovery of malls as institutional investments

Article Abstract:

Regional malls were once the brightest stars in institutional real estate investment. Now they are a losing venture, reflecting the miseries of a bad economy. Rising taxes, fickle-minded shoppers and retailers' lower profit margins will lead to a continuous limited upside cash flow and mall space vacancies. Crisis management and remerchandising together with changing marketing tactics to address the 1990s shopper, must be key points that mall investors must concentrate on to save their investments.

Merger madness: asset transfer can be tricky

Article Abstract:

Corporate mergers can result in disputes about the implementation of retirement plans and the transfer of assets and benefits. The need for corporations to be careful about asset transfers is demonstrated by a case involving the investment gains on a defined contribution plan that accrued before the actual transfer of the assets and after their valuation. The case's resolution highlights the need to transfers as much of the asset as possible on the valuation date.

Legal concerns loom over 401(k) education needs

Article Abstract:

A summary of each of the four potential areas of legal concern regarding the provision of investment advice to participants in 401(k) or other defined contribution plans is provided. The four possible areas of concern are the Investment Advisers Act of 1940, similar state securities legislations, ERISA fiduciary standards and common law standards relative to trusts, negligence and the like.
