Court dismisses class action alleging wrongful classification of "leased employees"

Article Abstract:

The U.S. District Court for the Central District of California dismissed a class action brought under ERISA. The case involved "leased employees" at the Atlantic Richfield Co. (ARCO) and its subsidiaries who claimed that according to ERISA, they were denied benefits. However, the court determined that though the employees could be classed as common law employees, terms of the ERISA plan exclude the plaintiffs.

Cash balance plans violate ERISA

Article Abstract:

The federal court of US has ruled that the IBM Corporation has violated ERISA's anti-discrimination provisions. It concluded that the IBM's pension changes took away benefits from older workers.
