A profitable alternative

Article Abstract:

The insurance industry should consider the opportunities available in the alternative market. Although there is some competition between traditional and alternative markets, cooperative applications are more frequent. Single-parent captives and group captives offer many benefits, including their relative freedom from form and rate regulations. Brokers, who have the least to gain from the captive mechanism, can benefit more from establishing private insurers.

Question marks surround judgement expense issue

Article Abstract:

Declaratory judgement expenses remain a contentious issue between reinsurers and ceding companies. Only one ruling on the subject has been made, but this was overturned on appeal and is still pending further review. Reinsurance agreements do not specifically cover declaratory judgement expenses, but insurers nonetheless expect to be indemnified by their reinsurance companies.
