Recent court rulings aid professional liability

Article Abstract:

A number of 1994 court cases have profound implications on the future of professional liability insurance. These decisions will give liability insurers a better understanding of their exposed risk. Additionally, many of these court decision define liability boundaries. For example, the Supreme Court's decision to overturn the use of the 1934 Securities and Exchange Act as a reason to prosecute those who aid in fraud may not preclude such illegal activities if done by professionals such as lawyers or accountants. Discussion of the various cases that will affect liability professionals is included.

Passage of disaster bill faces difficult future

Article Abstract:

Lawmakers hoping to pass a comprehensive natural disaster insurance bill in 1996 will have a difficult time making changes to existing standards. The formation of the Natural Disaster Insurance Corp. was scuttled by supporters after critics accused the plan of being an industry-supported bailout. Others claim that such plans will lead to federal regulation. Some suggestions include auctions of future contracts, an insurance corporation without federal guarantees, and a Treasury-appointed commission to file loss costs.

Congress fails on Superfund; battle shifts to courts

Article Abstract:

Superfund reform continues to be impeded by partisan politics. Unrealistic reform expectations by Republicans and preoccupation with the Contract with America contributed to the gridlock. Insurers are pressing Congress to attend to Superfund reform in 1997. The judicial system is expected to determine the future of Superfund until compromise is achieved.
