The Americans with Disabilities Act and Workers Compensation

Article Abstract:

The Americans with Disabilites Act (ADA) is perceived by employers as referring to new hires. However, injured workers who have sustained permanent disabilities are also covered by the ADA and will comprise the majority of the ADA complainants. In this regard, employers are advised to examine carefully their policies and practices concerning the industrially impaired. They are also urged to develop disability management programs that will later on result in enhanced productivity, increased safety in the workplace, less rehabilitation costs and less litigation.

Maybe workers comp is the problem

Article Abstract:

Dilemmas in workers compensation has been tackled in numerous articles, however, it cannot be ascertained whether defects in the system exist or the system itself is defective. Workers compensation should consider the consequences rather than the causes of the injuries suffered. The conditions covered by workers compensation laws have changed since they were passed. Under the present judicial system, employees are afforded more legal remedies advantageous to them.

The relevance of Americans with Disabilities Act to workers compensation

Article Abstract:

Workers compensation professionals should familiarize themselves with the Americans with Disabilities Act (ADA) because of its similarities with workers compensation laws. Provisions such as the definition of disability and pre-employment activity limitations may benefit workers compensation professionals in employing disabled workers. Key provisions of the ADA are discussed.
