A developer's communitarian ideals bite back

Article Abstract:

The Rouse Co, Maryland real estate developer is being criticized for its application to rezone a land tract from commercial to residential use because residents are afraid this would overburden local schools. James W Rouse, chmn of the company's board, recommended in 1973 as a member of the Citizens Advisory Committee on Environmental Quality Task Force on Land Use and Urban Growth that real estate development rights on private property depend on the community rather than property owners, an uncompensated expropriation of land users' rights.

NYSE land grab try: greed is still good

Article Abstract:

The proposed relocation of the New York Stock Exchange violates the Just Compensation Clause and is therefore an eminent domain battle fraught with moral implications. Arguments that this taking is for a public use fail and condemnees will only receive fair market value for their land rather than being truly indemnified. New York courts have a history of insensitivity to condemnees' arguments that takings of their land are for a private, rather than a public, purpose.
