A stealth anti-divorce weapon: Louisiana's 'covenant marriage' law passes without much notice

Article Abstract:

Louisiana passed an alternative marriage law for a covenant marriage which would require participants to receive pre-marital counseling and has strict standards for divorce. This law is an attempt by conservatives to reduce the number of divorces by having couples consider the step more carefully. The law was passed rapidly and family law practitioners were not notified. Opponents of the law support the pre-marital counseling but feel it should be tied to the no-fault divorce marriage to encourage the counseling rather than making it part of a more strict system.

Accounting gumshoes: lawyers increasingly rely on specialists to undercover fiscal fraud

Article Abstract:

Forensic accountancy is gaining popularity because of the complexity of criminal litigation. Forensic accountants both investigate and testify as expert witnesses. They must have a strong knowledge accounting, interviewing skills, an investigative mentality and an understanding of what is evidence and how courts work. The first significant involvement of forensic accountants was in the savings and loan scandal but they reached public attention during the O.J. Simpson trial where they looked for hidden assets.

Subtle tort reform: new restatement injects fault issue in design defect cases

Article Abstract:

The Restatement (Third) of Torts moves away from the concept of strict liability without fault towards a more balanced approach of products liability. Manufacturing defects, design defects, and inadequate warnings or instructions are the three types of product defects defined under the Restatement draft, each with a different set of applicable standards. The draft introduces a risk-utility test which critics charge favors manufacturers.
