One for all and all for one: reforming manslaughter law

Article Abstract:

UK manslaughter laws may require reforms to encompass workplace safety violations that cause death. Employers' gross negligence, a key element of involuntary manslaughter, has been charged in several cases, but corporate manslaughter liability law is a largely undeveloped area characterized by few prosecutions. Individual liability and identification of a corporation's "controlling mind" are difficult issues to resolve. The Law Commission proposes adding offense categories such as corporate killing, reckless killing, and killing by gross negligence. A number of actual cases are discussed as background.

EC finally adopts Seveso II Directive

Article Abstract:

The EC's Seveso II Directive creates a need for additional hazardous substance laws in the UK, although the changes in UK law will not be drastic. The Directive requires businesses to take proper step to prevent accidents involving hazardous substances and mandates establishment of a inspection system. Land use planning must consider environmental issues and emergency plans must be tested periodically according to the Directive. Specific duties of operators are also included.

Prison looms for director after Jackson Transport is convicted of manslaughter

Article Abstract:

Alan Jackson, ex-director of Jackson Transport, has been convicted in the UK of the 1994 manslaughter death of James Hodgson and will likely go to prison. The company was also convicted of manslaughter in the incident, in which Hodgson died from chemical exposure due to poor equipment, weak supervison, and safety violations.
