ABA goes over head of INS on detainee issue; ABA says INS refuses to give pro bono lawyers access to some detainees

Article Abstract:

TheABA is pressing the Immigration and Naturalization Service (INS) to give pro bono lawyers access to the many INS detainees being warehoused in jails. ABA negotiators were especially dismayed that INS officials did not produce the promised timetable to extend due process guarantees to detainees at state-run jails at a Dec 18, 1998 meeting. The ABA would particularly like the INS to commit to a timetable for giving the most vulnerable detainees easy access to a telephone, group legal counseling and legal library materials.

The article covers various jurisdictional issues, including new Y2K legislation providing for federal subject-matter jurisdiction in such class actions and supplemental jurisdiction developments. The article also briefly covers an 11th Circuit case, Bill Harbert Construction Co. v. Cortez Byrd Chips Inc., in which the Supreme Court has granted certiorari to rule on whether the special venue statute in the Arbitration Act is only permissive.

Article Abstract:

Congress has attempted to speed up litigation and decrease costs by amending parts of the diversity jurisdiction law and passing a supplemental-jurisdiction law to codify various judicially-created doctrines relating to federal subject-matter jurisdiction. Case law interpreting the existing diversity jurisdiction rules has become more complicated as disputes to control the litigation forum have increased in importance.
