Against cyberanarchy

Article Abstract:

Regulating electronic commerce is more feasible than skeptics claim. Skeptics argue the dissolution of geographical boundaries in cyberspace and the technological architecture of Internet transactions preclude any reasonable governance. The similarity between interpersonal transactions and electronic transactions is closer than skeptics believe. Territorial jurisdictions can be identified. Default laws may support the skeptics' position but regulatory laws argue for governance. Skeptics also underestimate the technological and legal ease with which conflicts regarding multi-jurisdictional transactions can be resolved.
