An experiment in reform; like snowflakes, no two plans for reducing civil delays are alike

Article Abstract:

Some 34 federal district courts have used the early 1990s to change their procedures in the hope of cutting civil litigation costs and court delays. They are the 'early implementation districts' required by the Civil Justice Reform Act of 1990 to have plans in place by the end of 1991 for reducing court congestion and delay. The 60 other federal district courts have until the end of 1993 to complete such plans. There are significant procedural differences between districts even though the plans emphasize congressionally required areas such as discovery and alternative dispute resolution.

Patients' privilege; therapist's tapes confidential even when mistress tells all

Article Abstract:

The prosecution of Hollywood, CA's Erik and Lyle Menendez for the murders of their parents may resume following a court ruling that many of the tapes the Menendez brothers' therapist made of their sessions could not be used in evidence, even though the therapist's mistress had made much of their contents public. The court ruled that a conversation need not remain secret in order to retain the privilege and that only tapes in which the brothers confessed to the murders met the 'dangerous patient' standard, lost the privilege and could be used as evidence.
