Antitrust policy in Ukraine

Article Abstract:

The Antimonopoly Committee of Ukraine (AMC) has developed an antitrust enforcement policy which successfully supports the Ukraine's transformation to a market economy from a state controlled economy. The AMC's antitrust policy has provided an economic and legal structure for the country despite obstacles such as economic crises and a lack of resources. Unlike western nations, which have forged an enforcement policy over many decades, the AMC has developed an antitrust enforcement policy within four years.

Vertical territory and customer resale restrictions: a new rule of reason approach

Article Abstract:

The courts need to view consumer value more expansively when applying the judicial rule of reason analysis to vertical territorial and customer resale restrictions. The courts have applied a limited economic analysis stressing pricing and product factors which does not reflect the realities in marketing schemes and consumer satisfaction. Judicial knowledge of these realities and recognition of the factor of service output levels would provide better consumer protection against antitrust situations.

More than just "new financial bingo": a risk-based approach to understanding derivatives

Article Abstract:

The over-the-counter (OTC) derivatives market is a mature market which must be invested in with caution. OTC derivatives provide advantages for investors who want customized risk management and do not mind the reduced transparency, liquidity, and self-monitoring demands. Large investor losses in the early 1990s served to educate investors and federal regulators. Recommendations for federal regulations are provided.
