Crimes against humanity: Nuremberg, 1946

Article Abstract:

US Supreme Court Justice Stephen G. Breyer recounts Justice Robert Jackson's thoughts as a prosecutor at the Nuremberg war crimes trials to demonstrate the importance of justice on the Holocaust Day of Remembrance, Yom Hashoah. Jackson believed that it was more important to create a conclusive record of atrocities than it was to ensure convictions against the Nazis on trial. By following the laws of evidence and providing the defendants the opportunity to speak, there would be no doubt that the crimes occurred. Ensuring such evidence would be part of history would instruct future generations that history must not be repeated.

The struggle against hate crime: movement at a crossroads

Article Abstract:

The criminal justice system has not participated in the otherwise successful institutionalization of principles against hate-crimes. The movement which has successfully advanced awareness of hate-crimes must now work to find methods which will effect change in the criminal justice system. The movement should now focus its efforts in the development of interrelated governmental mechanisms which earnestly target and address hate-crime issues.
