Arbitrator considerations in modifying discharge decisions in the public sector

Article Abstract:

Public sector employee discharge cases were analyzed to identify arbitrators' determinants for modifying discharge decisions. Four considerations were found to be the best predictors of modification: employee's previous work record, arbitrary management action, extenuating circumstances and failure of the evidence presented to justify the dismissal. Other considerations were related to management error. These results contravene the idea that arbitrators' decisions are inconsistent.

Demographic differences and faculty attitude toward collective bargaining

Article Abstract:

Professors at a medium-size, public university in Indiana were surveyed to determine how demographic variables influenced faculty stance towards collective bargaining. The bargaining issues covered were personnel, compensation, governance and academic factors. Results indicated that tenure status, income, sex and rank influence the faculty stance on this issue. Highest degree obtained, age and academic specialty did not have an impact.

The reshaping of nonrenewal and termination practices regarding teacher contracts: a Texas focus

Article Abstract:

The Texas Term Contract Renewal Act of 1981 is an example of nationwide trends towards increasing the accountability of public school teachers. The act provides for brief contracts, usually just one year, with renewal contingent upon good performance evaluations and passing a state competency test. Many school districts have a standard list of causes for not renewing contracts. Teachers have due process protections under the act.
