Article 228(2) EC and the enforcement of EC environmental law: A case of environmental justice delayed and denied? An analysis of recent legal developments

Article Abstract:

The impact of the infringement action under Article 228(2) of the European Community (EC) Treaty in assisting in the enforcement of EC environmental law is considered. Evidence suggests that in many instances Member States are not deterred continuing to delay or obstruct the correct implementation of EC environmental obligations into national law and practice and hence questions are raised whether the penalty infringement procedure under Article 228(2) has proved itself fit for the purpose.

Influence of the Aarhus Convention on access to justice in environmental matters in Estonia

Article Abstract:

The Convention on access to information, public participation in decision-making and access to justice in environmental matters that was signed in Aarhus on 25 June 1998 represents one of the most remarkable trends in modern environmental law recognition of the connection between environmental quality and basic rights. The general principles of the Aarhus Convention and the basics of administrative court review in Estonia are examined.

Legal transposition and implementation frameworks for Lithuanian approximation of EU Environmental Law

Article Abstract:

Lithuania's accession to the European Union (EU), the process of approximating EU environmental law and the legislative intricacies involved is presented. Given Lithuania's rich natural heritage and relatively untouched natural resource base, it is considered as a right move that Lithuania should aspire to become one of the EU's natural leaders in sustainable resource management and environmental wellbeing.
