Article Abstract:

Business law reform in Australia has slowed toward the end of 1995, but some activity is evident in trade practices, tax simplification and bank charges. The tax simplification debate has become particularly divisive, but the corporations law First Simplification Bill has received all needed approvals. Contract law remedies may be expanded to address economic duress as a basis for unconscionability claims. The Prices Surveillance Authority has not yet acted to address complaints regarding charges that banks are requiring for access to certain account information.

(Australian company and tax law reforms focus on return of capital, one person companies, competition policy and related party transactions.)(Editorial)

Article Abstract:

The tax and company law reform process has encountered complications regarding capital rules, one person companies, competition law and related party transactions. Reforms allowing small businesses to use a simplified method of incorporation are currently being scrutinized. The legislature has yet to consider proposals to change the way returns of capital are authorized. Other changes involve Australian Trade Practices Commission investigations and the restructuring of the Australian Competition and Consumer Commission.

Consumer Credit Code: the current Post-implementation Review

Article Abstract:

Australia's Consumer Credit Code went into effect on November 1, 1996. The Code provides protection for a broad range of products. The Ministerial Council of Consumer Affairs started a Post-implementation Review of enforcement in July 1998. The Review will inform the National Competition Policy process, inform the Council of the Code's effects, and recommend improvements. However, the impact of the Code on pre-contractual disclosure and the price of credit contracts must be clarified.
