Authority or reason? The economic consequences of liability for breach of statutory duty in a comparative perspective

Article Abstract:

The economic consequences of liability for breach of statutory duty is addressed by taking a statistical material from Germany which shows that quality of public service need not be reduced by holding regulators and civil servants liable for negligent or unlawful acts of omissions. Findings indicate that financial constraints have prevented the legislator from introducing stricter forms of liability for wrongs committed by public officials in the exercise of their duties.

The German private company limited partnership

Article Abstract:

The GmbH & Co KG, private company limited partnership type of entity is the commonest form of partnership used in Germany which consists of a limited partnership between private companies and other persons who are called Kommadisten who have limited liability. The GmbH & Co KG has proved useful entity for small business in the past but it is likely to continue to be popular in Germany and to be used for many different purposes in that country.
