Battle lines form over WIPO copyright bills; Congress' current session may resolve policy disputes relating to protection of digital media IP

Article Abstract:

The author surveys various bills implementing World Intellectual Property Organization treaties, which endorse the principle that adequately protecting copyright in digital media requires new legal solutions against the use of technology designed to defeat copyright protection technologies. The author argues that Congress could easily fall into the trap of over-protection of digital works.

Article Abstract:

The controversy regarding the Digital Millennium Copyright Act's (DMCA) ban on the dissemination of code-cracking technology is discussed. First Amendment challenges including claims that the DMCA chills academic freedom as well as fair use challenges are discussed.
