Battle on legal ads comes down to class; some deride 'reform' movement as elitist

Article Abstract:

Some 20 states are deliberating on new ethics rules to cover attorney advertising. this area. It is in TV advertising that class divisions among attorneys become most apparent. In Nevada, a study by attorney Peter C. Neumann found that decreased respect for attorneys could be attributed to radio and TV advertisements. The courts will not limit First Amendment rights unless a verifiable state interest justifies this action, and this has inspired both sides to search for surveys bolstering their point of view.

For lawyers, lure of the boardroom has its perils; serving on a client's board can lead to conflicts that would get an attorney fired or sued. Will the ABA ban the rule?

Article Abstract:

Corporate attorneys have always been attracted by membership in corporate boards, but as bad publicity about this practice mounts, it may be on the wane. Anecdotal evidence has it that attorney-directors are gaining popularity as targets of lawsuits. This may be due, in part to shareholder activism and the desire that boards have more independence. The ABA has convened the Task Force on the Independent Lawyer to study the issue.

Calif. court bars solicitation suit; it's a disciplinary matter

Article Abstract:

The California Supreme Court ruled in Rubin v Green that the proper venue for defendant objections when solicited by their opponents' attorneys was the bar disciplinary system rather than the courts. While the decision fails to define solicitation, it overturns an appellate court ruling permitting litigation to penalize the practice.
