A Colorado lawyer discipline panel's refusal to absolve from ethical wrongdoing a lawyer who posed as a public defender to bring a dangerous criminal off the streets is discussed.

Professional responsibility: should sexist comments be a disciplinary offense? Yes: offensive speech limits access to justice

Article Abstract:

Gender-biased behavior by lawyers or in the courtroom prevents equal access to justice, so courts should be able to discipline lawyers for such conduct. Numerous studies and task forces have found that lawyers cause much of the bias female attorneys encounter. Such behavior is often a prelude for worse, and it encourages others to follow suit if it is not strongly confronted. It indicates beliefs about who is worthy as an opponent, and who should have access to the courts and justice.

Beefing up lawyer ethics, competence is main goal: critics challenge New York proposal to open up discipline process, force arbitration in fee disputes

Article Abstract:

The NY Committee on the Profession and the Courts in Nov called for changes in legal training and practice to improve the profession's public image. Proposed measures include extensive practical and ethics training, more open disciplinary proceedings, and binding arbitration of fee disputes at the client's option. Hoped-for results include a refurbished image, greater lawyer competence, and better relations with clients. An increasingly competitive and impersonal profession makes professional lapses likelier.
