The great detective

Article Abstract:

The revolution in the criminal justice caused by the advent of DNA evidence is discussed. At least 18 states are considering laws mandating some form of post-convicting DNA testing in cases where prisoners maintain innocence, and nine states have already passed such laws. John Doe warrants and civil libertarians' concerns about DNA databanks are also discussed.

All about Allen; judges' charge to deadlocked juries comes under scrutiny

The pros and cons of the Allen charge, the instruction to juries given by the judge as an attempt to break a deadlock or avoid a mistrial, are discussed. Critics cite the number of cases appealed on Allen-related issues and the wide disparity on the charge's use among the circuits.

Crossing the state line? Violence Against Women Act battered in test of congressional powers under the commerce clause

Article Abstract:

A potential linkage of the interstate commerce clause to firearms use was the focus of two federal cases in the 1990s, U.S. v. Lopez, in which the Supreme Court struck down a law making firearms possession within 1,000 feet of a school a federal crime, and Brzonkala v. Virginia Polytechnic Institute, in which the US Court of Appeals for the 4th Circuit held the civil rights remedy of the Violence Against Women Act to be unconstitutional.
