Bills to implement WIPO treaties ignite debate; congressional legislation has drawn fire over such issues as fair use and liability of OSPs

Article Abstract:

Legislation to implement World Intellectual Property Organization Copyright and Performance/Phongrams treaties and to regulate online service providers (OSPs) was pending as of Oct 1997. Issues include the effect of the anticircumvention provisions on fair-use and public domain material. Treaty implementation and ratification have been tied to the outcome of the debate over OSPs liability for infringing transmissions on their networks.

Patent law; protecting software

Article Abstract:

Bettering the chance of successful enforcement in the spiralling number of new software patents is discussed. Patent owners should be proactive and search conduct prior-art searches fir anything that will impact the novelty of the method described in the patent. Searching both patent and nonpatent prior art is always essential.

Recent IP legislation is most sweeping in yuears; it includes broad changes to patent law as well as the new anti-cybersquatting statute

Article Abstract:

The Omnibus Appropriations Act of 1999 is discussed, and is a wide-ranging law containing the Anti-Cybersquatting Consumer Protection Act, adding further protections for owners of trademarks and altering US patent law in the most fundamental way since the Patent Act of 1952.
