Bombing spotlight turning to Nichols; lawyers in 2d Okla. City bomb trial learn lessons from McVeigh case, prepare for complications

Article Abstract:

Terry L. Nichols will have the second trial in the 1995 Oklahoma City Bombing case, and his lead attorney, Michael E. Tigar, has been watching the first defendant, Timothy McVeigh's trial, learning about any prosecution weaknesses which he could exploit. Tigar says the Nichols case is based more on circumstantial evidence, and thus on Nichols's associations. His client was indicted as a co-conspirator and as far as the death penalty goes, it is better for him that he was not at the scene of the bombing. Prosecutors say the motive for both McVeigh and Nichols was revenge for the government's 1993 raid on the Branch Davidian compound in Waco, TX.

Oklahoma state prosecutor Robert Macy hopes to succeed in obtaining a death sentence for Terry L Nichols in the 1995 Oklahoma City Bombing, even though federal prosecutors failed in this endeavor. Macy feels that bombing victims, their families and the state of Oklahoma suffered an affront when Nichols, the second bombing defendant after Timothy McVeigh, did not likewise receive a death sentence. Getting an untainted jury pool may, however be a big problem for Macy, regardless of which remote community becomes the site of the trial.
