Business crime; circuits split - again

Article Abstract:

Continuing disagreements in the rulings of the US Circuit Courts regarding 18 USC 666 are discussed. This is a statute proscribing theft from programs receiving federal assistance. The expansion of federal criminal jurisdiction implicated in Sec. 666 is also discussed.

Article Abstract:

Issues are discussed regarding the federal district court ruling in City of New York v. Coastal Oil New York Inc.on the attorney-client privilege in corporate counsel communications with former employees. Extending the privilege to witness preparation is recommended. Possible arrangements with former employees to strengthen the claim of attorney-client privilege are also covered.

Article Abstract:

Case law discussing the circumstances waiving the attorney-client privilege is summarized. The 4th Circuit's ruling in In re Grand Jury Subpoena ruled that an anonymous client will retain that status only when the attorney takes nonpublic actions. As soon as the attorney takes public actions, an adverse party may compel the disclosure of the client's identity.
