Business drowns in rules

Article Abstract:

Lawmakers should clarify employers' liability under current labor and employment statutes. The areas of sex discrimination and fetal protection are particularly difficult. When deciding whether or not to employ pregnant women, employers face the dilemma that sex discrimination in employment is illegal, but they are still liable for injuries resulting from workplace exposure to toxic chemicals. Other paradoxical areas are disability discrimination vs. negligent hiring, affirmative action vs. reverse discrimination, and right to privacy vs. reference checks.

The Third Annual 10 Wackiest Employment Law Cases list features remarkable claims, awards, acts of counsel, and workplace practices. Leading the list is Los Angeles' finding that a shower in a strip club, where patrons pay to watch dancers bathe, violates the Americans With Disabilities Act by being inaccessible to wheelchair-bound strippers. Other items include outbursts by lawyers, decisions favoring retention of violent employees, and more.

Unnecessary ingredient in antitrust enforcement

Article Abstract:

State governments should not pursue antitrust law enforcement for national mergers of companies. Such actions would duplicate the efforts of the FTC and Dept of Justice's Antitrust Division. These two federal agencies have issued new merger guidelines which will improve enforcement. An example of unnecessary state action is New York's suit to stop the merger of Philip Morris and RJR Nabisco.
