COBRA notice and coverage not required of disappearing employer following sale of assets

Article Abstract:

The Indiana Court of Appeals for the Third District found in Lim v. White that no notice is required when a corporation terminates all its employees and terminates health care coverage simultaneously and then dissolves. The Consolidated Omnibus Budget Reconciliation Act's post-employment health care benefits are not required when an employer ceases to provide coverage to any employees. The Court found that notice of a non-existent right was not required. The Court failed to address whether the corporation that bought the assets of the dissolving corporation had any responsibility to the terminated employee.

IRS clarifies two aspects of the long term care grandfather rule under HIPAA

Article Abstract:

Assumption reinsurance agreements for long-term health care will continue to be qualified and grandfathered as the original contracts were according to the IRS in Private Letter Ruling 9828016. Such agreements are used to transfer contract obligations between insurers. The agreement in the ruling continued the terms of the original contract. The IRS also considered the materiality of certain changes on contract status.

HCFA issues proposed rules for electronic transactions involving health plan data by health plans health care clearinghouses and health care providers

Article Abstract:

Health plan data which is electronically transferred between health care clearinghouses and providers will be subject to regulation as proposed by the Health Care Financing Administration and published in the Federal Register in May 1998. The proposed rules are the result of the Health Insurance Portability and Accountability Act of 1996's provisions requiring the development of standards regulating such data.
