Court's ruling in this case was that Community law rules out national legislation for damage individuals cause by infringement of Community law, if the court is judging at last instance because infringement question arises form an interpretation of provisions of law or evidence carried out by that court or appraisal of facts by that court. The judgment is a consistent follow-up of "Kobler" case law.
