Article Abstract:

The US needs tort reform for lawsuits cost the American consumer too much, and the surfeit of litigation slows American economic growth because the litigation tax is added to each item purchased. Attorneys receive almost half of the insurance company payouts in automobile insurance cases. The human cost of the litigation burden is also great, for companies are often afraid to continue making life-saving products. Among the tort-reform measures needed are a limitation of punitive damages, abolition of joint-and-several liability for noneconomic damages and promotion of early settlement

Unpublished opinions stunt common law

Article Abstract:

A trend toward publishing fewer judicial opinions is a disservice toward lawyers, litigants, and ultimately the courts themselves, in part by eventually leading to more litigation. New standards are needed to ensure that all significant opinions are published, especially those of first impression and those in which the trial judge's decision is reversed by an appeals court. More unpublished opinions only weaken the impact of precedent, at a relatively minor savings in publishing costs.

Copyright protection of privacy interests in unpublished works

Article Abstract:

Protection should be given to privacy interests in unpublished works under federal copyright law. The law should be amended to prohibit unauthorized use of such unpublished works while the author is alive, extending three to five years after the author's death. In addition, both facts and expression in the unpublished work should be covered. Currently the author's privacy interests are not adequately protected by federal copyright law or state privacy law.
