Copyright protection of computer software: what is it and how did we get it?

Article Abstract:

Copyright protection for computer software was allowed under the 1978 amendments to US copyright law and codified in the Computer Software Copyright Act of 1980. However, some computer software has the characteristics of both literary and audio-visual works, complicating the application of copyright infringement. Numerous cases have now established some predictability to the application of copyright law to computer programs, but the results still depend on the type of program and the jurisdiction in which the case is tried.

The EEC's Directive on software protection and its moral rights loophole

Article Abstract:

The European Economic Community Software Protection Directive addresses copyright issues in an attempt to stabilize the European software market and allow it to compete with US software developers. However, the Directive fails to address moral rights and allows national law to set precedent which reduces its effectiveness in creating clear and consistent software protection laws for EC countries.

Promises to keep: American views of developments in Chinese copyright law

Article Abstract:

China must strengthen its copyright laws and more vigorously punish its citizens who reproduce US and other nations' computer software programs without permission if it wants to attract foreign investment and enjoy international technological cooperation. Specifically, China must fulfill its obligations under the Berne Convention and offer reciprocal protection of foreign intellectual property.
