Compromising confidences: recent court rulings weaken privileges protecting private communications

Article Abstract:

Two state high courts have narrowed the protections for confidential communications in two criminal cases. In New Jersey v. Szemple, the New Jersey Supreme Court found that confessions made to a minister who then communicated them to others were not privileged. Only the clergy could exercise the privilege, not the defendant. In Michigan v. Caruso, the Michigan Supreme Court found that in camera review of privileged psychiatric counseling records for discovery purposes is appropriate if the motion for review is made with particularity.
