Confusion follows '96 landmark patent case; 'Markman' decision didn't turn out as most predicted

Article Abstract:

Many experts predicted that the Supreme Court ruling in Markman v. Westview Instruments, Inc. would remove many of the most difficult issues from patent infringement trials and thus shorten litigation and encourage summary judgments or pretrial settlements, yet these predictions did not come true. The US Court of Appeals for the Federal Circuit has overturned about 40% of post-Markman claims interpretations, and according to many experts litigation time has become longer and the trend since the 1970s toward jury trials of patent claims has continued unabated.

Kevorkian's lawyer goes on the offensive

Article Abstract:

The attorney for the Michigan 'suicide doctor' Jack Kevorkian is Geoffrey N. Fieger, who has assumed a high profile in publicly defending his client. He has called some of the prosecutors investigating Kevorkian names and accused one of pursuing Kevorkian in furtherance of his own political ambitions. The publicity seems to have helped his practice and he denies having lacked manners in his defense of the doctor.

Bonuses spread in-house

Article Abstract:

It is becoming customary to include bonuses in the compensation packages of all corporate attorneys and bonuses reflect the company's financial performance during the year rather than the attorney's performance. The bonus can comprise 30 to 40% of the general counsel's compensation package. Generally, the decision regarding the bonus is made in one year and it is paid in the next.
