Confusion over s. 522(d)(11(D): what Congress really meant by exempting payments for "personal bodily injury" and why they got it wrong

Article Abstract:

The author discusses the exemption in federal bankruptcy law allowing debtors or their dependants to receive payment for personal bodily injury under very limited circumstances. A new version of the law that would respect the individual tort systems of the states is proposed.
