Consultation regulations under fire

Article Abstract:

Michael Meacher of the UK Labour Party attacked the Collective Redundancies and Transfers of Undertakings Regulations 1995 during a House of Commons debate in Feb, 1996. He said the regulations promoted union derecognition, failed to outline employee representative election procedures, and imposed a 20-employee redundancy consultation threshold designed to circumvent existing protections. Consumer Affairs Minister John Taylor defended the regulations as cost-saving, efficient, deregulatory, and providing adequate consultation requirements.

Definition of "establishment" under Collective Redundancies Directive

Article Abstract:

The European Court of Justice, ruling in the 1996 Rockfon A/S case, held the EC Collective Redundancies Directive's definition of "establishment" to mean the redundant workers' individual work unit. The aggregate numbers of workers within a corporate group of associated companies cannot be the basis for determining redundancies or defining an establishment under the Directive. The implications of this ruling for UK companies remain unclear.

Part-timer's redundancy pay claims time-barred

Article Abstract:

The UK's Employment Appeals Tribunal ruled against three part-time workers' claims for redundancy pay, stating the industrial tribunal lacked the jurisdiction to hear the claim. The workers' claims were barred because they brought the under the Employment Protection Act, which sets a six-month limit for such claims. Their claims might have been allowed if they had brought them under Article 119 of the Treaty of Rome.
