Court KOs Microsoft with Tunney Act; plus some automation suggestions for the counsel of the Simpson affair

Article Abstract:

Microsoft's extended litigation with the US Justice Dept's Antitrust Division has entered a new phase following the Jan 20, 1995 hearing at which District Judge Stanley Sporkin redefined the government's role in such investigations. Sporkin also rejected Microsoft's consent decree with Justice in another decision undertaken in Feb 1995. Sporkin is primarily concerned with Microsoft's alleged unfair and anticompetitive practices for marketing its software. Sporkin is disturbed about allegations that Microsoft's so-called 'vaporware,' or software not yet ready for market, is publicized far in advance of its release, which tends to dissuade users from buying competing products that are already available.

Breaking up is hard to do: some legal pros propose their own remedies in the Microsoft ruling

Article Abstract:

Four legal professionals propose what they would regard as suitable remedies to impose in Microsoft's antitrust trial. One opinion would require Microsoft to observe a number of guidelines and publish relevant APIs, so that competition in the software industry would be protected. Another opinion would punish Microsoft less dramatically, possibly with a fine. One of the commenters says the best remedy is no remedy. He sees no reason why a Web browser should not be part of an operating system.

Tech leasing for lawyers

Many small businesses lease technology as a comman practice and as many as 80 percent of all businesses have used leasing technology. Some leasing tips are provided and advantages and disadvantages of leasing are presented.
