High court hears state action case: at issue: can insurers for state programs be sued?

Article Abstract:

The pending Supreme Court case American Manufacturers Mutual Insurance Co. v. Sullivvan concerns whether injured workers have a due process right to notice and the chance to be heard before a private insurance company suspends payment of a questionable medical bill pending its review under the state's exclusive system of no-fault liability for work-related injuries. The court would have to rule that private insurers in a state worker's compensation program are state actors and that injured workers are deprived of a property interest when payment is delayed.
