Article Abstract:

Criticisms of the independent counsel law, Title VII of the Ethics in Government Act, which is due for reauthorization in 1999, include the lack of prosecutorial experience of the single-case prosecutors appointed, the probable self-promotion through questionable decisions to look for minor violations and through leaks to the press, and the increased cost to the government through independently hired personnel outside the Department of Justice.

Criminal law; self-incrimination

Article Abstract:

The Supreme Court ruled in Mitchell v. United States that a waiver of the Fifth Amendment privilege against self-incrimination at sentencing did not result from a plea of guilty. The court reaffirmed the breadth of the concept of incrimination under the privilege, and that the waiver of rights of the guilty plea is only a waiver at trial.

Grand jury secrecy

Article Abstract:

In re Sealed Case, a D.C. Circuit ruling supporting grand jury secrecy, is discussed. The court ruled that most grand jury disclosures other than criminal law must be court-approved and were appropriate only when the need outweighed the public interest in secrecy.
