Decision offers lenders a new weapon
Article Abstract:
Riveredge Associates v Metropolitan Life Insurance Co, a US District Court decision, allows lenders to bring actions against borrowers who sue them in bad faith. An action by the borrower alleging claims at variance with those of the loan documentation, or at variance with the plaintiff's understanding of the agreement, may violate the covenant of good faith and fair dealing. Under Riveredge, this would permit the lender to file suit and obtain damages.

Hirschfeld derives his income from credit card payments for these answers to legal questions.

Fla. couple face possible big sanction; $500,000 at stake over 'frivolous' suit
Article Abstract:
The possibility of a sanction against attorneys Karen and Bill Amlong for for demonstrating bad faith and filing a frivolous suit is discussed. This sanction may come because they represented a client in a sexual harassment suit when they had ample evidence that the allegations were a lie.
