Digital innovations now challenge legal system: U.S. and foreign governments study the impact of digital technology on existing IP laws

Article Abstract:

The Working Group on Intellectual Property Rights under the Clinton administration's Information Infrastructure Task Force released on Sept 5, 1995, its final report on recommended changes in US and international law. The report incorporated some 1500 pages of commentary on a preliminary version, and agreed with several international commissions that existing copyright law is fundamentally sound, but that changes and clarifications are needed. Proposed amendments to the Copyright Law are discussed.

Protecting art images; whether a museum or archive owns reproductions depends on the originality involved

Article Abstract:

The article discusses Bridgeman Art Library v. Corel Ltd., a 1999 US District Court for the Southern District of New York ruling dealing with both the originality standard for fine art reproductions and choice-of-law issues. The ruling and its "probative" similarity test is likely to impact film, photo archives and image libraries, both the vendors and creators of visual images.

Patent law; protecting software

Article Abstract:

AT&T Corp. v. Excel Communications, Inc. reinforced the holding that practical applications of algorithm-based software are patentable. This case reinforced State Street Bank & Trust Co. v. Signature Financial Group, Inc., a 1998 holding and reaffirmed adherence to precedent. 35 USC 101 is the statute at issue.
