Disability Rights Commission bill

Article Abstract:

The pending Disability Rights Commission bill sets up functions for such an agency similar to those of the Equal Opportunities Commission and the Commission for Racial Equality, and much of the bill relates to employment. The agency's general duties would be to work towards the elimination of discrimination against the handicapped, to promote equal opportunities for handicapped people, and to keep reviewing the workings of the Disability Discrimination Act 1995 and of the bill when it becomes law.

Schizophrenia sufferer was disabled person under DDA

Article Abstract:

The British Employment Appeals Tribunal ruled in Goodwin v. The Patent Office that a schizophrenic whose illness caused difficulties concentrating and communicating was disabled within the meaning of the Disability Discrimination Act. An employment tribunal wrongly held that he did not meet the act's definition of "disability" because he could cope with the practicalities of living alone.

Subsequent losses need not be foreseen

Article Abstract:

The Court of Session ruled in Leonard v. Strathclyde Buses that common law concepts such as foreseeability and causation should not be considered in determining an employee's loss for unfair dismissal. Courts should instead apply the statutory test as a whole and decide what is equitable given the loss attributable to the employer.
