Domestic violence and U.S. asylum law: eliminating the "cultural hook" for claims involving gender-related persecution

Article Abstract:

The author discusses the cultural hook interpretation applied to asylum law to determine whether victims of domestic abuse can be granted asylum and the shortcomings of this interpretation, then proposes means to provide equal treatment in such asylum cases.

The author discusses provisions of the 1996 Welfare Reform Act which allow states to deny public benefits to legal immigrants. Topics include the constitutional implications of Congress' attempt to devolve federal immigration powers to the states.

Commandeering under the treaty power

The author contends that the anti-commandeering principle balancing federal goals and states rights set forth by the Supreme Court in Printz v. United States should not constrain the federal government's implementation of treaty obligations.
