Effective use of "employment practices experts" in employment litigation

Article Abstract:

Employment practices experts have become popular with both plaintiffs' and defense attorneys, but many fail to get the best effect from such testimony. Experts in a field in which jurors often feel competent must be highly qualified, able to educate rather than pontificate, and knowledgeable about what topics jurors are likely to have misconceptions about. Experience representing both sides in lawsuits is more valuable than usual, as is real-world experience to complement theoretical knowledge.

ADR flexibility in employment disputes

Article Abstract:

The most effective way to make use of alternative dispute resolution (ADR) methods to resolve employment disputes is to be open to combining different methods. Legal disputes in the workplace are often tangled up with work and personal matters. Fact-finding and investigation are often necessary precursors to actual dispute resolution. The various methods available, including mediation, arbitration and facilitation, should be employed based on the needs and expectations of the parties involved.

Article Abstract:

An amendment to the 1977 directive on acquired rights has been adopted by the Council, changing the scope of the directive which will now apply to any transfer of an economic entity retaining its identity. A co-ordinated strategy for national employment policies was endorsed at a special jobs summit in November 1997, and a set of employment guidelines has been approved. The Commission has commented that overall employment rates in the EU have fallen during the past 20 years.
